Copyright and Infringement


Purpose
Helios respects intellectual property rights and requires all users to do the same. This policy explains copyright basics, user responsibilities, and how to report or respond to copyright violations on the platform.


1. Understanding Copyright

  • Copyright protects original works such as written content, images, videos, audio, software, and designs — but not ideas themselves.
  • Protection starts automatically once a work is created and fixed; registration gives extra legal benefits.
  • Owners have exclusive rights to reproduce, distribute, create derivatives, display, and perform their works.

2. Prohibited Conduct
Users may not:

  • Copy, upload, or share copyrighted content without permission.
  • Distribute or sell protected works without authorization.
  • Create derivative works based on copyrighted materials.
  • Plagiarize others’ content or ideas.
  • Bypass digital rights management (DRM) or technical protections.

3. User Responsibilities

  • Only upload or share content you own or have permission/license to use.
  • Respect copyrights, trademarks, and other IP rights.
  • Attribute creators properly when using allowed content.
  • Understand that “fair use/fair dealing” is limited and case-specific — when unsure, get permission.

4. Reporting Infringement (DMCA Process)

  • Helios follows the U.S. Digital Millennium Copyright Act (DMCA) and similar laws globally.
  • Rights holders can send a DMCA Takedown Notice with required details (signature, work description, infringing material location/URL, contact info, good-faith statement).
  • Helios removes or disables access to infringing material once a valid notice is received.

5. Counter-Notification

  • Users can contest mistaken takedowns by submitting a Counter-Notification (signature, removed content info, good-faith statement, consent to court jurisdiction).
  • Helios may restore content after 10–14 business days if the original complainant does not file a legal claim.

6. Repeat Infringers

  • Helios may suspend or terminate accounts that repeatedly infringe copyrights or commit severe violations.
